Terms and Conditions of trading Mile 13.

These Terms & Conditions of Trading apply to all Consumer contracts between Mile 13 and our Subcontractors (“us/we/our”) and the Customer (“you/your”) in relation to the sale of goods made via the Internet or Telesales. Separate Terms & Conditions apply for all orders placed in or via our shop and trade accounts.

Our Terms & Conditions were updated January 2024.

1. PAYMENTS AND PRICING

  1. We accept most major credit cards, along with Apple Pay and PayPal.
  2. Your billing address must match the address that the card/account used is registered to.
  3. Payments that fail the CVV (3 digit) check, or the postcode check will be automatically rejected.
  4. Please note all transactions are carried out in Pounds Sterling (GBP). 
  5. All online pricing and offers should be considered on an ‘invitation to treat’ basis and as such we reserve the right to decline any orders placed by you.
  6. At times, our payment system may ask for additional security information, in these instances we will contact you directly. Please be assured this is for security purposes only intended to protect you and us.
  7. The Contract shall not be concluded until we have received your valid credit or debit card payment into our account, additional payment security (where applicable) has been concluded and we have accepted the order by means of an email confirmation to the address that you have given during the registering procedure and upon ordering.
  8. Your personal details will be encrypted.
  9. Product information and pricings may be subject to change without notice.
  10. No VAT is payable, and no VAT receipt will be given. Mile 13 is not a VAT registered business.
  11. All orders have 100% of the total order value taken at the point of order.

2. DELIVERY AND STOCK LEVELS

  1. Time is not of the essence in these Terms and Conditions of Trading. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances.
  2. We endeavour to get your order to you within 5 days (stock permitting).
  3. We sell in the UK market only.
  4. We hold a comprehensive selection of stock however this is not guaranteed. If you order anything which is not in stock we will contact you if we feel this will adversely affect the supply time to you.
  5. Delivery on orders of value under £25 will be charged at £12.99. Order Values between £25 and £74.99 will be charged at £8.99. Any order value of £75 and above is free. We do not currently ship internationally. Orders are UK only.
  6. Standard deliveries are made Monday to Friday, excluding Bank Holidays and we are closed Saturday, Sunday and UK Bank Holidays.
  7. Your order will be delivered by our chosen Carrier and must be signed for. Any issues should be reported within 24 hours of your delivery confirmation. We cannot investigate any issues after this time frame.
  8. We will deliver only to the address stated on the purchase order, by our chosen carrier.
  9. If you elect another address or select a ‘safe place’ delivery directly with the carrier we cannot be held responsible for any issues thereafter.

3. GUARANTEES

  1. The provision of this clause applies in addition to your statutory consumer rights in relation to faulty or miss-described goods. These rights are not affected by the guarantee. 
  2. For the purpose of this clause the Guarantor is Mile 13.
  3. Unless otherwise stated all products carry a one year guarantee and cannot be transferred.
  4. Slight surface imperfections are typical of natural leather used in our products and should not be considered defective. 
  5. In the event of a claim under guarantee please contact us in the first instance with your name, order details, photos and a summary of the issue. 
  6. Your claim will be assessed and if valid, an appropriate resolution will be provided to resolve matters.
  7. Upon proof of fault we will endeavour to repair the goods free of charge. If a repair is not possible you will be offered a replacement to the same value and only if a suitable replacement is not available will you be offered a full or partial refund depending on the age of the goods.
  8. When an item is returned for review or repair you are responsible for all shipping costs associated with returning items to us and, if applicable, back to you. 
  9. When goods are returned from overseas countries the package and associated documentation must be marked ‘British returned goods of outbound…’ adding the original carrier name and tracking number’, failure to do so may result in us rejecting the return. All goods must be returned on a DDP (delivery duty paid) service back to us using your own tax identification number. In any event, any fees incurred by us in this regard will be charged back to you and deducted from any refunds owed to you.
  10. These guarantees do not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage (including rusting or corrosion) due to unreasonable exposure to water, heat or weather; due to fire, smoke, explosion, lightning, sunlight, or theft, or accidental damage or loss caused by a third party. 
  11. We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods over and above the value of the goods themselves. This does not affect your statutory rights.
  12. Due to the varying nature of motorcycles all descriptions given for parts are for reference only and are not a guarantee of their suitability for any specific motorbike.

4. 30 DAY RETURNS POLICY

  1. In addition to your statutory rights we offer a 30 day returns policy (from order date) if you change your mind.
  2. If you wish to return the goods under this policy it is your responsibility to take good care of the products whilst in your care as you are liable for any loss or damage. This may result in rejection of your refund and you will be liable for the cost of returning to you.
  3. Please return using appropriate packaging, pack well and do not attach labels to product boxes.
  4. All original product boxes, labels, protective film, additional items (e.g. armour), product bags etc. as supplied to you and are returned along with the unused and ‘as new’ product.
  5. In the event that any of the items being returned are contrary to clause 2, 3 and 4 we reserve the right to deduct monies owing to you to cover the repair / replacement of such items. 
  6. Please complete the returns form received with your order and include it in your parcel. Failure to complete and include this form may delay the process.
  7. All items remain your responsibility until received safely by us regardless of the returns method used. In any event you should use a ‘sign for’ service.
  8. Upon receipt we will review carefully to ensure everything is in re-saleable condition (including all original packaging as per clause 4). 
  9. When/if accepted by us we will process your refund as soon as possible minus any pre-paid delivery charges that you may have paid.
  10. The refund will be paid to you by the method in which you originally paid.
  11. Exchanges will be processed as soon as possible. 
  12. If there is any difference in price to what you originally paid you will be liable for the difference. This includes any items purchased during a Sale period where the replacement item/size you require is no longer available at the Sale price you paid. We will contact you to discuss this.
  13. Strictly no returns on Trade Orders. Trade Orders are classified as purchased by or delivered to a company address, this also includes any form of production company (film, TV etc).

5. FREE GIFTS AND PROMOTIONAL CODES

  1. If you return any item for a refund, any free gifts received with the original order must also be returned, unused, unopened and fully resaleable. If they are not returned or are returned unsalable their full value will be deducted from any monies that are owed to you.
  2. We reserve the right to substitute free gifts if the advertised gift is temporarily unavailable.
  3. Promotional codes are applicable per order, i.e. you cannot use several codes for one order and cannot be used retrospectively.
  4. Promotional codes cannot be used on discounted or sale items, unless otherwise stated.
  5. We reserve the right to exclude chosen brands and/or collections from any promotional code including the newsletter sign up code. Please note that promotional codes will not work on excluded brands/ranges.

7. HELMET SAFETY STANDARDS

  1. It is your responsibility to ensure that you purchase a Helmet that conforms to your local safety standard (e.g. ECE for UK, European Riders and many other countries). 
  2. Helmets are purchased/worn at your own risk and we accept no responsibility for loss or damage to person or property as a result of its use.

8. WEBSITE TERMS OF USE

  1. We endeavour to display as accurately as possible the colour of products as they appear on the Website and we cannot guarantee that your monitor/equipment will accurately reflect the colour of the product delivered.
  2. Every effort is made to ensure the accuracy of our Website however some prices and information may change from time to time and it is possible that errors may occur. We will use our best endeavours to rectify any errors as quickly as possible but we cannot be held accountable for any losses incurred.
  3. To the maximum extent permissible by law, we exclude all warranties, expressed or implied as to the accuracy of the information contained in any of the material on the Website. We cannot accept any liability for any particular material on the Website as a result of any use or reliance placed upon the information contained on the Website.
  4. Any material downloaded or otherwise obtained through the use of this Website is done so at your own discretion and risk. You will be solely responsible for any damage to your own systems/devices or loss of data that results from the download of such materials.
  5. All content and information on this site including, without limitation, text, graphics and images are the property of the Website or the property of their respective owners and are protected by the UK Copyright Laws.
  6. All Trademarks that appear on our Website are the property of their respective owners.
  7. If you access our Website from outside of England and Wales you do so on your own initiative and you hereby agree that in the event of any dispute between Mile 13 and you the laws of England and Wales will apply at all times.
  8. We control and operate the Website from our office in England. Accordingly the laws of England and Wales govern claims relating to, and including the materials contained therein.

9. FURTHER INFORMATION

  1. Mile 13 is a registered data controller in accordance with the Data Protection Act 2018 (the “Act”) and we process your personal data in accordance with the Act.
  2. Mile 13 accepts no liability for any loss or damage to body, bike or third parties whilst using any garment or product purchased. This does not affect your statutory rights.
